How Does Comparative Negligence Affect Injury Claims in Howell, NJ?

New Jersey's comparative negligence law can affect how much an injured person may recover when more than one party shares responsibility. In New Jersey, being partly at fault for an accident doesn't automatically bars you from getting money, it allows you as long as you aren't more to blame than the other people involved. Any damages are reduced according to the percentage of negligence attributed to the person seeking recovery.

That rule can become relevant when a crash occurs on a busy highway such as I-195. A claim may involve questions about each driver's conduct, including whether a driver followed traffic rules, maintained proper control, or contributed to the circumstances that led to the roadway collision. Evidence such as photographs, witness accounts, medical records, and available crash documentation can help establish how responsibility should be evaluated.

In New Jersey, if a lawsuit goes to court, a judge or jury must assign a specific percentage of blame to everyone involved in the accident. When multiple people share responsibility, those percentages can directly affect the amount a claimant may recover. A personal injury lawyer can examine the available evidence and explain how the comparative negligence rules may apply to each particular claim.

If you have questions about how shared fault could affect your injury claim, we can explain the applicable New Jersey rules. At The Law Offices of Sander Budanitsky, we can help clarify how comparative negligence may affect your legal options.
