How Is Fault Determined After a Multi-Vehicle Crash in Union, NJ?

After a multi-vehicle crash in Union, fault is determined by reviewing each driver’s actions before the collision and whether traffic laws were followed. Several drivers may share responsibility if their actions contributed to different impacts. A driver who was speeding, distracted, or following too closely may bear some responsibility for the crash.

To determine what happened, police and insurance companies may examine crash reports, vehicle damage, photographs, witness statements, and nearby video footage. These records help establish the sequence of events and each driver’s role in the crash. They may also reveal whether a driver failed to yield or violated another traffic rule.

When several insurance companies are involved, each may investigate the collision separately. Their findings may differ, which can delay settlement discussions. To keep track of the process, save insurance correspondence and request written explanations of claim decisions.

While fault is being determined, your personal injury protection (PIP) insurance generally covers eligible medical expenses, regardless of who caused the crash. The amount available depends on your policy’s coverage limits and terms. Checking your benefits can help you understand what your insurer may pay while the investigation continues.

If you share some responsibility for the crash, New Jersey law may reduce your compensation based on your percentage of fault. You generally cannot recover damages from another driver if your share of fault exceeds 50%. An accurate assessment of each driver’s responsibility can help determine the compensation you may receive.

When several drivers are involved in a crash, a car accident lawyer can review photographs, vehicle damage, and witness statements to help determine fault. An attorney can also communicate with the insurance companies on your behalf.
