Who Can File a Wrongful Death Claim in New Jersey?
In New Jersey, the executor or administrator of the deceased person’s estate files a wrongful death claim on behalf of eligible surviving family members. Typically, the people who benefit from that claim include a spouse, children, and parents of the deceased, although the specific circumstances of each case determine who qualifies.
New Jersey’s Wrongful Death Act allows surviving family members to seek compensation for the financial losses they suffer as a result of losing their loved one. These losses can include funeral and burial expenses, lost future income and financial support, and the value of services the deceased person provided to the household.
The law recognizes that a sudden death creates real and lasting financial hardship for the people left behind, and it provides a legal pathway to address those losses.
Timing matters in New Jersey wrongful death cases. The state generally allows two years from the date of death to file a wrongful death claim in court. Missing that deadline can permanently prevent surviving family members from seeking compensation.
Consulting an attorney as early as possible helps ensure that no critical deadlines pass and that key evidence — including the police report, witness statements, and any available surveillance footage — remains accessible while the investigation is still active.
Families dealing with the aftermath of a fatal crash often face questions about next steps while managing grief and financial uncertainty at the same time. An attorney can help organize the legal process, communicate with insurance companies, and explain what compensation may realistically be available based on the specific facts of the case.
