Who Can File a Wrongful Death Claim in Elizabeth

In Elizabeth, wrongful death claims are typically filed by the executor or administrator of the deceased person’s estate. This representative acts on behalf of the deceased’s eligible beneficiaries, who often include a surviving spouse, children, or other dependents such as parents or siblings who relied on the deceased for financial support, care, or household services.

The court considers the level of dependence each beneficiary had on the deceased when determining how any recovery is distributed.

These claims are intended to help families recover compensation for the financial and emotional losses caused by the death of a loved one due to another party’s negligence.

Compensation in a wrongful death claim can cover a range of losses, including funeral and burial expenses, lost financial support, lost household services, and the emotional value of companionship, guidance, and care the deceased would have provided.

In some cases, families may also pursue a separate survival action to recover damages the victim could have claimed before death, such as medical expenses, lost income, and pain and suffering.

Because wrongful death cases in Elizabeth involve strict filing deadlines and procedural rules, it is important to seek legal guidance promptly. An Elizabeth wrongful death attorney can help families determine eligibility, gather evidence, and ensure all claims comply with New Jersey law.

Navigating a wrongful death claim can be overwhelming while coping with grief. Attorneys experienced in Elizabeth can provide both practical and emotional support, helping families understand the legal process, communicate with insurance companies, and pursue fair compensation.

This assistance ensures families can access the resources they need to cover expenses and begin to recover from the loss of a loved one.
