The crash is still being investigated.
We hope everyone involved in the crash is able to make a full and lasting recovery.
People injured in a car accident in New Jersey may be eligible for compensation depending on how the crash occurred, the insurance policies involved, and the severity of their injuries.
New Jersey generally requires drivers to carry personal injury protection (PIP) coverage. PIP may pay eligible medical expenses and certain other losses after a crash, regardless of who caused it, subject to policy limits and applicable terms.
However, PIP does not cover every type of loss, and access to compensation for pain and suffering may depend on the policy selected and whether the injury meets the applicable legal threshold.
When another driver’s negligence contributes to a collision, an injured person may also have grounds to pursue a liability claim. New Jersey follows a modified comparative negligence rule. Generally, an injured person may recover damages if their share of fault does not exceed the fault of the party they are suing, although compensation can be reduced based on their percentage of responsibility.
New Jersey generally has a two-year statute of limitations for personal injury lawsuits, though exceptions can apply. Claims involving public entities may have additional notice requirements and shorter deadlines. Reviewing the relevant insurance policy and seeking legal guidance can help clarify the options and deadlines that may apply.
