How Long Do You Have to File a Car Accident Lawsuit in Union, NJ?

After a car crash in Union, you have two years to file a personal injury lawsuit in New Jersey. The deadline usually begins on the date of the collision. Missing it may prevent you from recovering compensation through the courts.

In the weeks following a crash, your medical treatment can help document head pain and other developing symptoms. Your records may connect those symptoms to the collision. Waiting too long to seek care can create questions about when and how your injury occurred.

Across this part of Union, the Garden State Parkway connects with busy roads near Chestnut Street, U.S. Route 22, and Interstate 78. Heavy merging traffic may contribute to sudden collisions. Roadway footage and vehicle damage may help explain what happened.

Before the filing deadline arrives, you should identify the responsible parties and available insurance coverage. Evidence can become harder to obtain as time passes. Your photographs, medical records, insurance notices, and available video may help support your claim.

During the insurance claim process, settlement discussions do not always pause the two-year filing period. An insurer may continue reviewing your claim as the deadline approaches. You should not assume that ongoing negotiations protect your right to file a lawsuit.

When legal deadlines create concern, an attorney can determine when your filing period began and whether an exception may apply. A lawyer can also preserve your evidence and communicate with insurers. Starting early gives you more time to investigate the collision and prepare your claim.

At the Law Offices of Sander Budanitsky, we help injured people across New Jersey understand their legal options. Our team reviews your evidence and insurance coverage while guiding you through each stage of the claims process.
