How Long Do I Have to File a Car Accident Claim in Springfield, NJ?

In Springfield and throughout New Jersey, you generally have two years from the crash date to file a personal injury lawsuit after a car accident. Missing that deadline may prevent you from seeking compensation, even when you have a valid claim.

Although you may have two years to file a lawsuit, notify the appropriate insurer as soon as possible. Policies often require prompt notice, and delays may complicate claims for medical benefits, vehicle repairs, liability coverage, and other crash-related expenses.

If a public agency or employee may be involved, a shorter notice period could apply. Claims involving a government vehicle, roadway, or public property need immediate review because the usual two-year period may not control every required notice.

Depending on the circumstances, separate time limits may apply to insurance benefits, property damage, and a lawsuit against another party. Reviewing each possible claim early can help you avoid confusing one deadline with another.

After the crash, keep medical records, bills, photographs, repair estimates, insurance letters, and the crash report together. These documents can help show your injuries, expenses, and daily limitations during the claims process.

Even if settlement discussions continue, an insurer’s negotiations usually do not stop the filing deadline. Ongoing treatment, a pending offer, or requests for additional information should not make you assume that more time is available.

Before the deadline gets close, a lawyer can identify the filing period that applies to your circumstances and track key dates. An attorney can also keep track of important dates while you focus on your recovery.
