How Long Families Have to File a Wrongful Death Lawsuit in Union, NJ

New Jersey law sets a statutory time limit, known as a statute of limitations, for filing wrongful death claims. Family members or legal representatives must file the lawsuit within two years from the date of the deceased person’s death. Missing this deadline can result in the loss of the right to pursue a claim.

After a Union fatal pedestrian accident, surviving family members may have the right to file a wrongful death lawsuit in New Jersey. These claims allow families to seek compensation for the losses and damages resulting from the untimely death of a loved one.

Eligible parties who can file a wrongful death lawsuit include:

  • Spouse and children of the deceased
  • Parents if no spouse or children survive
  • Other dependents in some circumstances
  • Personal representatives of the estate who can file on behalf of beneficiaries

Wrongful death lawsuits can seek compensation for:

  • Medical expenses related to the fatal injury
  • Funeral and burial costs
  • Loss of financial support and income
  • Loss of care, companionship, and guidance

Families pursuing a claim must demonstrate that the death resulted from another party’s negligence or wrongful conduct. Gathering evidence such as police reports, witness statements, medical records, and accident scene documentation is critical.

Due to the strict timeline and legal complexity, families need to act promptly. Consulting an attorney can help ensure that claims are properly filed and that all potential avenues for compensation are explored.
