Elizabeth, NJ – Scooter Driver Killed, Passenger Critical After Crash With Hyundai on Newark Ave

May 16, 2026

Elizabeth, NJ (May 15, 2026) – A motor scooter and a Hyundai collided on Newark Avenue near the Walgreens parking lot in Elizabeth late Wednesday night, May 13, killing the scooter driver and leaving a passenger in critical condition. The crash happened at approximately 9:24 p.m.

Preliminary findings indicate the Hyundai was attempting to turn into the parking lot when it collided with the scooter traveling south on Newark Avenue. Emergency units transported the scooter driver to Trinitas Regional Medical Center, where he later died from his injuries. A passenger on the scooter suffered severe injuries and was taken to University Hospital in critical condition.

The Hyundai driver remained at the scene and cooperated with investigating officers. Authorities confirmed that next-of-kin notifications have been made. The identity of the scooter driver had not been released as of Thursday afternoon.

The crash remains under active investigation.

We extend our deepest condolences to the family of the scooter driver who lost his life, and we wish the passenger a full recovery.

Legal Options Families Have After a Fatal Scooter Accident in Union County

When a scooter accident claims a life in New Jersey, the surviving family members may have the right to file a wrongful death claim against the party responsible for the crash. Elizabeth is one of Union County's busiest cities, with heavy traffic along corridors like Newark Avenue and Route 1. Crashes involving turning vehicles and two-wheeled riders happen with troubling regularity. Understanding what legal options exist helps families make informed decisions during an incredibly difficult time.

New Jersey's Wrongful Death Act allows certain surviving family members to seek compensation for the financial losses caused by their loved one's death. Eligible parties typically include a spouse, children, or parents of the deceased. These claims can cover funeral and burial expenses, lost future income the deceased would have contributed to the household, and the loss of companionship and guidance.

Things like witness statements, traffic camera footage, vehicle damage patterns, and the official crash report all help reconstruct what happened in the moments before impact. New Jersey follows a modified comparative fault standard, meaning that if investigators find that one of the parties shared any responsibility for the crash, compensation may be reduced proportionally. Building a clear and accurate account of events early in the process protects the family's claim.

New Jersey also sets a two-year statute of limitations for both wrongful death and personal injury claims. Families dealing with grief and medical emergencies can lose track of these deadlines quickly. Consulting an attorney helps file a claim early and preserve the evidence before it becomes harder to obtain.
