Understanding New Jersey’s Fault System After a Crash in Linden, NJ
New Jersey drivers typically choose between two auto insurance options that affect how a claim works after a crash: a limitation-on-lawsuit policy, usually called the verbal threshold, or an unlimited right-to-sue policy.
Under the verbal threshold option, an injured person generally needs to show a permanent injury before pursuing a claim for pain and suffering against the at-fault driver.
New Jersey also follows a modified comparative negligence standard, which means that an injured person can recover damages as long as they’re found 50 percent or less at fault for the crash.
A personal injury lawyer can help a victim determine which type of policy applies to their claim and whether their injuries meet the threshold required to pursue compensation beyond PIP coverage. New Jersey generally allows two years from the date of a crash to file a personal injury claim.
