What Can Families Recover After a Wrongful Death in Mountainside, NJ?

New Jersey's Wrongful Death Act allows certain beneficiaries to seek damages when a person's death results from another party's wrongful act, neglect, or default. The claim generally must be brought by a legally authorized representative of the estate, rather than simply by any family member individually. Under current New Jersey law, a wrongful-death action generally must be filed within two years after the person's death.

The damages available under the statute are tied to the financial losses caused by the death. These can include the pecuniary losses suffered by eligible beneficiaries, as well as hospital, medical, and funeral expenses incurred for the deceased.

New Jersey law also recognizes the financial value of certain benefits that beneficiaries would have received from the deceased, such as services, care, advice, and support.

It is very important to document these losses. Records that concern medical treatment before death, funeral expenses, financial contributions, and the services or support the deceased provided can help establish the economic consequences.

Because New Jersey requires these claims to follow specific procedures, families may benefit from legal guidance before attempting to pursue recovery. At The Law Offices of Sander Budanitsky, we can review your available information and explain how the state's wrongful-death rules may apply to your situation.
