Medical documentation can provide important evidence of the injuries caused by a vehicle accident. In New Jersey, a person seeking damages for an injury generally must bring the action within two years after the claim accrues, which makes it useful to maintain records from the beginning of treatment.
Treatment records can show when symptoms first appeared, what medical providers diagnosed, and what care was recommended. Hospital records, physician notes, imaging results, therapy records, prescription information, and medical bills help establish the nature and financial consequences of an injury. To keep records of missed work or other documented losses can also help show how an injury affected daily life.
Documentation can also become relevant if the other side disputes the extent of the injuries or argues that another factor contributed to the losses. Since New Jersey follows a comparative negligence system, a person's damages can be reduced by the percentage of negligence attributed to that person when the statutory requirements for recovery are met.
