Drivers covered by the limitation on lawsuit option can generally seek pain and suffering damages only for certain injuries, including death, dismemberment, significant scarring, displaced fractures, and permanent injuries.
For these cases, a physician must certify permanence based on objective clinical evidence. Drivers who selected the no limitation option are not held to that restriction.
The choice is made when a policy is bought or renewed, many drivers do not remember which option they picked. The declarations page usually shows it. Under the limitation option, the physician's certification generally must be filed within 60 days after the defendant answers the complaint, and it must rest on findings such as imaging or test results rather than reported pain alone.
Medical records tend to carry the most weight in this process. Treatment notes that describe limits on movement, ongoing symptoms, and follow-up visits can help show whether an injury fits one of the statutory categories.
