People injured in a truck accident on Interstate 80 in Allamuchy, NJ, may have legal options for seeking compensation if negligence contributed to the crash. Determining responsibility can be complex and may require examining several drivers and companies.
Truck drivers must follow traffic laws and federal safety regulations. Depending on the circumstances, investigators may examine fatigue, speed, following distance, distraction, vehicle maintenance, and cargo security. Weather, road conditions, and other motorists’ actions may also be relevant.
Potentially responsible parties may include a truck driver, trucking company, maintenance provider, or another party whose negligence contributed to the crash. A trucking company may be liable in certain circumstances for an employee’s conduct or its own failures involving hiring, training, supervision, or maintenance.
Evidence is essential to evaluating these claims. Police reports, photographs, witness statements, electronic vehicle data, maintenance records, and trucking company documents may help establish how the crash occurred. Dashcam footage and surveillance recordings may also be useful, so preserving relevant evidence promptly is important.
New Jersey follows a modified comparative negligence system. An injured person’s compensation may be reduced according to their share of fault, and recovery is generally barred if their fault exceeds the combined fault of the parties they are pursuing. Multiple insurance policies may apply, with commercial trucking coverage involving different limits and procedures from standard auto insurance.
New Jersey generally allows two years to file a personal injury lawsuit, although exceptions may apply. Claims involving public entities can have additional notice requirements. Injured people should preserve medical records, bills, proof of lost income, and insurance correspondence while reviewing their legal options.
