New Jersey's comparative negligence law can allow an injured person to recover damages even when that person is partly responsible for a crash, provided the person's negligence is not greater than the negligence of the party or parties from whom recovery is sought. Any damages awarded are reduced according to the percentage of negligence attributed to the person seeking recovery.
For example, questions about speed, lane position, following distance, or other driving conduct could affect how fault is assigned if those facts become relevant to a claim. Many routes that run across Lopatcong Township, such as Route 22, have varied posted speed limits along the township portion of the highway.
Determining each person's share of fault can require careful review of available evidence. Medical records can establish the injuries and related treatment, while photographs, witness accounts, vehicle damage, traffic-camera footage, and other records may help establish how the collision occurred.
When fault is disputed, the evidence can become particularly important in evaluating a potential claim. Our team at the Law Offices of Sander Budanitsky can review your available records and explain how New Jersey's comparative-negligence rules may apply to your case.
