What Compensation Can I Receive After a Car Accident in Union, NJ?

After a car accident in Union, you may be able to receive compensation for medical expenses, lost income, vehicle damage, pain and suffering, and other losses caused by the crash. The amount available depends on the circumstances of your case.

Because New Jersey follows a no-fault insurance system, your coverage may pay certain medical expenses after a crash. Personal injury protection generally covers eligible medical costs regardless of which driver caused the collision, up to your policy limits.

Depending on your policy, your right to pursue pain and suffering damages may be limited. New Jersey drivers who choose a limited right to sue generally must meet the state’s injury threshold before seeking these damages through a lawsuit.

Under New Jersey’s comparative negligence rule, your recovery can be affected if you share responsibility for the crash. The amount you receive may be reduced according to the percentage of fault assigned to you.

To support your claim, gather photographs, medical records, repair estimates, wage information, and other documentation showing what happened and how the crash affected you. Keeping these materials organized can also make disputed issues easier to address.

In New Jersey, you generally have two years from the date of the crash to file a personal injury lawsuit. If you miss the deadline, you may lose the right to take your claim to court, although some exceptions can apply.

During the claim process, a lawyer can review the circumstances, communicate with insurers, and explain how New Jersey law may affect your case. This can help you make informed decisions about what to do next.

At the Law Offices of Sander Budanitsky, we help injured people across New Jersey after car accidents. We can help you understand the insurance coverage available and how it may apply to your claim.
