What Legal Options May Be Available After a Workplace Injury in Hamilton Township, NJ?

A person injured in their workplace may have legal options through workers’ compensation or, in certain circumstances, a separate claim against a third party.

New Jersey workers’ compensation generally provides benefits for employees who suffer injuries arising out of and in the course of their employment. Depending on the circumstances, benefits may cover reasonable and necessary medical treatment, a portion of lost wages during qualifying periods of disability, and certain permanent impairment benefits. Workers’ compensation is generally handled separately from a lawsuit against an outside party.

A third-party claim may be possible if someone other than the employer contributed to the unsafe condition. Potentially responsible parties could include a property owner, maintenance contractor, construction company, or manufacturer, depending on the facts. For example, evidence of improper installation, inadequate maintenance, defective components, or failure to address a known hazard may be relevant when evaluating liability.

Evidence can be especially important. Photographs of the scene and surrounding work area may help document what happened. Maintenance records, inspection reports, work orders, witness accounts, and any available surveillance footage may also help establish whether a preventable hazard existed.

An injured worker should keep records of medical visits, treatment recommendations, work restrictions, missed work, and related expenses. Promptly reporting the injury to the employer and following medical guidance can also help create a clear record of the claim. Workers should avoid assuming that workers’ compensation is their only possible source of recovery before the circumstances have been reviewed.
