How Do You Prove Liability After an Interstate Highway Collision in Bethlehem Township, NJ?

To prove liability in a New Jersey interstate highway collision, you must establish driver negligence by gathering key objective evidence, such as New Jersey State Police crash reports, traffic camera footage, vehicle black box data, and physical roadway telemetry, to show that the at-fault motorist violated traffic laws and caused the accident.

Demonstrating negligence under New Jersey law requires proving four core elements: that the driver owed a duty of care to operate their vehicle safely, that they breached this duty by breaking traffic rules, that the breach directly caused the crash, and that you suffered actual physical or financial damages as a result.

Under New Jersey’s modified comparative negligence statute, an injured motorist or passenger can recover financial compensation as long as their share of fault for the crash is 50 percent or less.

If an injured victim is assigned a partial degree of fault, such as driving slightly over the speed limit, their final financial recovery is reduced proportionally by that percentage. However, if a victim is found to be 51 percent or more at fault, they are completely barred from recovering damages.

Because insurance adjusters often attempt to assign partial blame to victims to minimize payouts, securing strong physical evidence early is vital.

Personal injury attorneys support crash victims by obtaining official State Police reconstruction logs, securing eyewitness statements, analyzing point-of-impact vehicle damage, and auditing available insurance policies, including first-party Personal Injury Protection (PIP) and third-party liability coverage, to pursue maximum compensation under state law.
