What Mistakes Should I Avoid After a Pedestrian Accident in Elizabeth, NJ?

After a pedestrian accident in Elizabeth, some common mistakes to avoid include leaving without calling the police or putting off medical care. Avoid saying the crash was your fault. Posting about the accident online or accepting a quick settlement can hurt your claim.

Even though you weren't in a car, insurance may help cover your medical bills. New Jersey's PIP insurance can cover pedestrians. You may be covered through your own auto policy, someone in your household, or the vehicle that struck you.

If an insurer says you share some of the blame, you may still have a claim. New Jersey reduces your compensation based on your share of fault. If you are found more than 50% responsible, you cannot recover compensation.

If the driver has little or no insurance, check whether your auto policy includes uninsured or underinsured motorist coverage. A household member's policy may also help. What is available depends on the coverage in those policies.

Beyond what PIP pays, you may be able to recover compensation for future medical care, lost wages, and reduced earning ability. You may also receive compensation for pain and suffering. If the limitation on lawsuit option applies, you may need to meet a serious injury requirement for those damages.

Under New Jersey law, you generally have two years from the accident date to file a personal injury lawsuit. Some exceptions apply. If you miss the deadline, you could lose your chance to recover compensation through a lawsuit.

If an insurer questions whether all of your injuries came from the crash, a pedestrian accident lawyer can compare its position with the medical records and other documentation. An attorney can also challenge unsupported attempts to reduce what the insurer pays and handle further discussions on your behalf.
