What Legal Options Exist After a Workplace Machine Injury in Fanwood, NJ

Workers hurt by machinery on the job are generally covered under New Jersey’s workers’ compensation system, which provides no-fault benefits regardless of who was at fault for the accident.

Injuries that involve industrial machinery can be severe. Crush injuries, broken bones, or traumatic brain injuries, if a worker loses consciousness, as was reported here. Recovery from this type of injury often involves extended hospital stays, surgery, and long-term rehabilitation, along with significant time away from work.

While workers’ compensation generally covers authorized medical treatment and a portion of lost wages, it typically does not allow an employee to sue their employer directly. However, if the machine itself was defective, poorly maintained, or lacked proper safety guards due to a manufacturer’s design flaw, a separate product liability claim against the manufacturer may be possible outside the workers’ comp system.

To determine whether this kind of claim applies usually requires an inspection of the equipment, which is why a personal injury lawyer’s early involvement can matter before a machine is repaired, altered, or removed from the scene.

At The Law Offices of Sander Budanitsky, our team can help injured workers understand both the workers’ compensation process and whether a separate claim against an equipment manufacturer may apply. We can explain what steps to take to help preserve evidence related to the machine involved.
