Cherry Hill, NJ (October 9, 2026) – A man died Thursday night, October 8, after a car struck him while he was crossing Route 38, according to the Cherry Hill Police Department.
Police said the man, identified as a 36-year-old man, was crossing near Longwood Avenue just before 8 p.m. on Thursday, October 8, when an eastbound car hit him.
The driver was not injured and stayed at the site. Route 38 was temporarily closed in both directions while officers investigated.
The investigation is ongoing, and police have not released what led to the collision.
Our thoughts are with the man's family and friends during this difficult time.
New Jersey treats a death caused by someone else's negligence as two claims, and each allows different damages: a wrongful death act and a survival act.
On one hand, the Wrongful Death Act allows a family to recover the financial losses caused by the death, including the income and benefits the person would have earned, the value of household services they provided, and the guidance, advice, and counsel they gave their loved ones. Funeral and burial costs and medical bills tied to the final injury can be included as well.
On the other hand, the Survival Act allows recovery for the pain and suffering the person endured between the injury and death, along with medical expenses and income lost during that time. When the conduct behind the death was especially egregious, punitive damages may also be available under, though they require a higher level of proof.
To prove these damages, records and professional opinions are required. Pay stubs, tax returns, and benefit statements document lost income, while economists and vocational experts can project what the person would have earned and contributed over time.
