Newark, NJ (October 9, 2026) – A 54-year-old Georgia man died Thursday morning, October 8, after a Honda left the highway and struck him on the shoulder of Interstate 78 westbound.
New Jersey State Police said troopers were called at about 9:34 a.m. to the westbound lanes near milepost 55.4 for a crash.
A preliminary investigation indicates the man was driving a Ram pickup truck westbound when he pulled over and stopped on the right shoulder.
Police said the Honda passenger vehicle ran off the right side of the highway onto the shoulder, struck the man, and continued into his parked pickup. The man died from his injuries.
The cause remains under investigation by State Police.
Our thoughts are with the deceased person's family and friends.
When someone dies because of another person's negligence in New Jersey, the law creates two separate claims, and each has its own rules about who files and what can be recovered. The Wrongful Death Act covers the family's losses, while the Survival Act lets the estate recover for what the person went through before dying.
A personal representative chosen by the court files a wrongful death claim to get compensation for the deceased person's family members. Damages can include the financial support and services the person would have provided, the loss of companionship, advice, and guidance, and funeral and medical expenses.
Time limits to file these claims are strict. New Jersey generally allows two years from the date of death to file a wrongful death claim, and Survival Act claims follow a similar two-year period.
