In Summit and throughout New Jersey, you generally have two years from the date of a car accident to file a personal injury lawsuit.
In certain situations, claims against New Jersey public entities generally require a notice of claim within 90 days. If you were injured as a minor, the lawsuit deadline is usually paused until you turn 18, although special rules may apply.
To support your claim, you can gather police reports, crash photos, medical records, treatment bills, and witness contact information. These documents can help show what happened, establish the extent of your injuries, and support your financial losses.
Depending on your losses, you may seek damages for medical expenses, lost income, property damage, and pain and suffering. New Jersey’s insurance rules and limits on lawsuits may affect which losses you can recover.
While negotiating with an insurance company, keep in mind that settlement discussions generally do not stop the filing deadline. Even if the insurer is still reviewing your claim, you may need to file a lawsuit before your time runs out.
Once the deadline passes, you may lose the right to pursue damages through a lawsuit. Even if you have strong evidence to support your claim, the court may dismiss your case unless a legal exception applies.
If you are unsure how much time remains to file your car accident lawsuit, a car accident lawyer can identify the applicable deadline and help you prepare the necessary documents. An attorney can also handle insurance negotiations and file your case in court if a settlement cannot be reached.
