Determining fault can become more complicated when several vehicles are involved because each driver's actions may need to be evaluated separately. In New Jersey, a person's recovery can be reduced when that person is found partly responsible for their injuries, so consequently, evidence about how the collision unfolded is particularly significant.
In a chain of impacts, useful evidence may include photographs of vehicle damage, statements from people who witnessed the roadway movements, medical records, and available traffic or roadway information. The sequence matters because one driver's actions may contribute to a later impact that involves another vehicle.
In New Jersey, victims are generally allowed to recover damages as long as their negligence is not greater than 50%, with damages reduced according to the person's percentage of fault. A personal injury lawyer can examine the details of the accident to determine whether another driver's conduct contributed to the injuries and how comparative negligence could affect a potential claim.
