How Does PIP Coverage Function Under New Jersey No-Fault Auto Laws?

In New Jersey, personal injury protection (PIP) coverage generally serves as the primary source of auto-related medical coverage for individuals hurt in a traffic collision, regardless of who caused the accident.

Under the state's no-fault auto insurance system, a person's own PIP policy can cover medical evaluations, hospital visits, diagnostic testing, rehabilitation, and a portion of lost income, subject to the policy's selected limits and terms. PIP may apply even when another driver was responsible for the collision.

After a crash, knowing how PIP works can help injured people determine where medical bills should be submitted.

Auto insurers generally handle covered accident-related treatment before a person's health insurance becomes the primary source for those expenses. Depending on the policy, PIP may also provide benefits for certain essential services or other covered losses. Keeping insurance information, medical records, bills, and claim correspondence organized can make it easier to track the benefits being requested.

PIP coverage does not necessarily resolve every financial loss following a serious collision.

If another driver was negligent and the injured person's losses extend beyond available PIP benefits, additional legal options may potentially exist depending on the circumstances and the person's insurance policy. The severity of the injuries, applicable policy terms, and New Jersey's insurance rules can all affect how a potential claim is evaluated.

Because medical billing and insurance requirements can become complicated, a personal injury attorney can help review the available coverage and documentation.

Legal counsel may assist with PIP claim forms, communications with insurers, medical records, and questions about whether additional compensation may be available. An attorney can also explain how the applicable insurance coverage may affect potential legal options.
